ShutterCue Terms of Service
1. Acceptance of These Terms
These Terms of Service ("Terms") govern your use of the ShutterCue mobile application (the "App"), operated by Digital Jackalope, LLC ("we," "us," or "our"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.
2. What ShutterCue Is (and Is Not)
ShutterCue is a reference tool. It suggests a starting exposure (ISO, aperture, shutter) and matching camera menu settings based on the gear, scenario, and lighting you select, using a combination of curated photographic knowledge and exposure math.
The recommendations are starting points, not guarantees. They are not a substitute for a light meter, your own metering, or your judgment as a photographer. Lighting, intent, and equipment behavior vary; always review your results (for example, your histogram) and adjust. We are not responsible for missed shots, exposure errors, or any creative or technical outcome from using the App.
3. License to Use the App
We grant you a personal, non-exclusive, non-transferable, revocable license to use the App for your own photography. You agree not to:
- copy, modify, reverse-engineer, decompile, or create derivative works of the App, except where permitted by law;
- resell, sublicense, or commercially redistribute the App or its data;
- use the App in any unlawful way or in violation of these Terms.
4. Your Content and Data
The gear, profiles, and preferences you create in the App are stored locally on your device and belong to you. We do not collect or store them. See our Privacy Policy for details on how your information is handled.
5. Intellectual Property
The App, its design, its curated knowledge base, and the ShutterCue name and logo are owned by Digital Jackalope, LLC and protected by applicable intellectual-property laws. "Nikon," "Nikkor," and "Z" are trademarks of Nikon Corporation; ShutterCue is an independent product and is not affiliated with, sponsored by, or endorsed by Nikon. Other product and brand names are the property of their respective owners and are used for identification only.
6. Pricing and Purchases
The App is currently free and contains no in-app purchases. If paid features are introduced, their pricing and terms will be presented to you in the App and processed by the Apple App Store or Google Play Store under their respective terms. These Terms would be updated accordingly.
7. Disclaimer of Warranties
The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the recommendations are correct for every situation or that the App will be uninterrupted or error-free.
8. Limitation of Liability
To the fullest extent permitted by law, Digital Jackalope, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of photographs, opportunities, or profits, arising out of or related to your use of (or inability to use) the App. Where liability cannot be excluded, it is limited to the amount you paid for the App (which, for the free version, is zero).
9. Changes to the App and These Terms
We may update, change, or discontinue the App or any feature at any time. We may also revise these Terms; changes take effect when posted to this page, and we will update the "Last Updated" date above. Your continued use of the App after changes are posted means you accept the revised Terms.
10. Governing Law
These Terms are governed by the laws of the United States and the state in which Digital Jackalope, LLC is organized, without regard to conflict-of-laws principles. Any dispute will be resolved in the courts located there, unless applicable consumer-protection law provides otherwise.
